Terms and Conditions of Sale
Preamble
The website www.observatoiredutourisme.ma is a platform dedicated to publishing and disseminating strategic data related to the Moroccan tourism sector. Its main objective is to provide tourism stakeholders with decision-making tools through reliable, up-to-date indicators and specific publications.
1- Subject
These General Terms and Conditions of Sale (GTCS) govern all transactions offered by the Observatory of tourism (hereinafter referred to as “OT”) on its website. They specify the rights and obligations of the parties concerning premium subscription services and the purchase of individual publications.
By using the services, the user acknowledges having read and agreed to these terms and conditions in their entirety.
2-Services Offered
The OT offers the following options:
- Public Access: Free access to a selection of Dashboard data, publications, and tourism indicators.
- Premium Subscription: Annual subscription allowing full access to all site content, including the Dashboard, indicators, and publications.
- Single purchase: Single purchase of one or more publications.
3-Service Access
The Premium Subscription provides unlimited access to the “OT Premium” Dashboard and all OT publications for 12 months. The subscription is valid for one year from the date of payment.
Single purchased publications are available in digital format and can be downloaded after payment.
4-Pricing
Prices for subscriptions and publications are indicated in Moroccan Dirhams (MAD). The OT reserves the right to change prices at any time, however the rates applied will be those in effect at the time of order confirmation.
5-Payment Methods
To place an order, the OT offers two payment options:
- Bank Transfer: Payment details (OT’s bank information) are provided when the order is confirmed. Service access is granted once the OT receives the transfer.
- Online Payment: Payments are processed through the secure platform of the Centre Monétique Interbancaire (CMI). Upon successful payment, a confirmation email is sent to the user.
The user certifies to the OT that they have all necessary authorizations to use the selected payment method when placing the order.
6-Fraudulent Use of Credit Cards
The OT is not responsible for fraudulent use of a credit card by a third party. It is the cardholder’s responsibility to immediately report any unauthorized use to the card issuer, according to their contract.
In cases of proven fraud, the cardholder remains responsible for payment until an official report has been made to the card issuer. The OT reserves the right to suspend or cancel any fraudulent orders and may take legal action against any attempt at fraud or misuse of its services.
7-Ordering Process
The user is responsible for providing complete and accurate information when placing an order. The order process on the OT website involves the following steps:
- The user creates an account in the “Sign Up/Log In” section if not already registered.
- The user selects a subscription by clicking “Purchase Subscription” or chooses one or more publications by clicking “Add to Cart”
- The user confirms the order by clicking “Confirm Order” and accepts the General Terms and Conditions of Sale, which they acknowledge having read.
- The user enters their contact details, selects a payment option, and completes the order by clicking “Place Order”
- The user completes payment via bank transfer or the secure online platform of the CMI.
8-Proof of Transactions Paid by Credit Card
The data recorded by CMI on its multi-channel payment platform on behalf of the OT serves as proof of all transactions between the user and the OT.
9-Force Majeure
The TO is only bound to fulfill its obligations insofar as they are not hindered by an event of force majeure.
10-Data Protection
Collected information is processed in accordance with applicable personal data protection laws. Users have the right to access, correct, and delete their personal data.

11-Modification of General Terms and Conditions of Sale
The OT reserves the right to modify these Terms and Conditions at any time. Any changes will be published on the site and will take effect upon posting.
It is the user’s responsibility to regularly review the GTCS to stay informed of any updates. By continuing to use OT’s services after changes have been published, the user agrees to the updated terms.
12-Liability
The OT is not liable for indirect damages resulting from the use of services offered on its website.
13-Applicable Law
These GTCS are governed by Moroccan law. In the event of a dispute, the parties will seek an amicable resolution. Failing that, the dispute will be submitted to the competent courts.
